We have worked with a number of Regulatory Agencies, acting as external Solicitors and pioneering advisory services on Legal and regulatory matters within the power sector.
We supported Clients in Tariff negotiations with NERC and Embedded Power Generation Companies. We advised on the legal and regulatory requirements regarding the cost components and allowable deductions in determining the tariff margins based on the building blocks of the Multi Year Tariff Order (MYTO). This included the production of tariff models based on input assumptions (using several scenarios in line with NERC requirements) that assured our Client of revenue recovery over the 10 Year price control period. Our role involved critically analysing the input assumptions and ensuring that the tariff model(s) based on the several scenarios are in line with the MYTO 10 Year Order, the MYTO methodology and other associated laws and regulations.
We also partnered with other International Firms in the divestment of 60% of an Electricity Distribution Company (EDC) to an Investor in the Power and Gas Sector. Our role involved the provision of legal advisory and due diligence services for the Investor on the acquisition of an EDC.
