THE HATE SPEECH BILL: AN OVERVIEW


The Independent National Commission for the Prohibition of Hate Speeches Bill (“Hate Speech Bill”) is an extensive piece of legislation pending before the 9th National Assembly. It covers various issues touching on the concept of hate speech, including the publication or presentation of materials deemed to stir up ethnic discord. It also targets written or visual acts perceived to be threatening, abusive, insulting or offensive. 

 

The Bill has been widely criticized by various Civil Society groups and stakeholders. One of the biggest criticisms is that the Bill prescribes capital punishments for certain offences. Critics of the Bill believe that the provisions of the Bill run contrary to the Spirit of the 1999 Nigerian Constitution, which protects the rights to freedom of speech, expression and association.
